Terms of Service

1. What we sell

Marstudio sells: the Business Review (a fixed-price written review); the AI Company (a one-time setup plus a monthly plan); the Partner plan (a monthly fee plus a share of sales, no setup fee); and catalog software as one-time source-code purchases. Prices are listed on the relevant pages. Payments are processed by Whop, or by Polar for some catalog products.

2. Delivery

After you pay for a first step, a template or the AI Company setup, you fill a short brief and we deliver to the email you gave at checkout. Catalog products are delivered electronically (zip via email) typically within 24 hours of purchase, often within minutes. Custom builds are delivered per the timeline agreed in writing before the work starts. Delivery is to the email address you provide at checkout.

3. License

Upon delivery, you receive a perpetual, worldwide, non-exclusive license to use, modify, host, and deploy the source code for your own business purposes. You may not resell the code as-is or as a near-identical template. You may not pretend to be Marstudio.

4. Included support

Every catalog order includes 14 days of unlimited email support: setup questions, bug fixes, small additions, and clarifications to setup or documentation. After 14 days, ongoing maintenance is available via the optional retainer described on the product page.

5. Refunds

AI Company. The setup has no money-back guarantee: once you claim a founding spot, we start designing and building your company by hand. Your monthly plan starts the day your company goes live, never before, and you can cancel it at any time; it stops at the end of the month already paid. Your monthly plan includes the Claude workspace your company runs on: we open it in your company's name and pay for it while your plan is active, and if you leave we transfer it to you.

Partner plan. No setup fee; a monthly fee plus a share of sales, with a minimum term set on the partner page. If the partnership ends before that minimum, the partner pays the regular founding setup fee shown there. When it ends, the business, its accounts and its customers stay with the partner; the AI team keeps running only on a regular monthly plan. An ad fund is optional: advertising results are not guaranteed, money spent on ads cannot be refunded, and campaigns can lose money.

Everything else. Because our work and products are delivered electronically, refunds are reviewed on a case-by-case basis. If what you receive materially fails to match its description, contact admin@marstudio.dev within 14 days and we will work toward a fix or refund. Monthly plans can be cancelled at any time and stop at the end of the month already paid.

6. Acceptable use

You agree not to use any product or service from Marstudio to:

• Send unsolicited spam in violation of CAN-SPAM, GDPR, or similar laws.
• Scrape websites in violation of their terms of service or robots.txt.
• Build automation that harasses, defrauds, or harms third parties.
• Reverse-engineer payment systems or circumvent rate limits of third-party APIs.

7. Warranty disclaimer

Products are provided "as is" with no implied warranty of merchantability or fitness for a particular purpose. We do our best to ship working, audited code, but you are responsible for testing it in your environment before relying on it.

8. Limitation of liability

To the maximum extent permitted by law, Marstudio's total liability for any claim related to a product or service is limited to the amount you paid for that product or service in the prior 12 months.

9. Governing law

These Terms are governed by the laws of Uruguay. Any dispute will be resolved in the courts of Punta del Este, Uruguay, unless otherwise required by law.
